Acceptance of Terms
By creating an account or using any application in the Her Journey Suite, you agree to be bound by these Terms of Service. If you do not agree, do not use the Suite.
These Terms, together with our Privacy & Health Data Policy, constitute the entire agreement between you and Ziggy Tech Ventures LLC regarding your use of the Suite.
Description of Service
Her Journey: Phase is a consumer wellness application — not a medical device or healthcare provider. Nothing in this app constitutes medical advice, diagnosis, or treatment.
Her Journey: Phase provides menstrual cycle tracking, ovulation insights, mood logging, and partner support tools. These features are designed to support your wellness journey with information and tracking — not to replace the judgment of your doctor or OB-GYN.
Always consult a qualified healthcare professional for menstrual irregularities, fertility concerns, or any health symptom that concerns you.
User Accounts & Responsibilities
You are responsible for:
- Maintaining the security of your account credentials
- All activity that occurs under your account
- Providing accurate information during onboarding and in your profile
- Using the Suite only for lawful, personal, non-commercial purposes
- Not sharing your account credentials with unauthorized persons
You must be at least 13 years old to use the Suite.
Subscription & Billing
Free Tier
Basic features are available at no charge.
7-Day Free Trial
Her Journey Pro includes a full 7-day free trial with access to all Pro features. No charge during the trial period.
After Trial
At the end of your trial, you are automatically charged at the current Pro subscription rate (monthly or annual, as selected).
Cancellation
Cancel at any time from Settings › Subscription. Cancellation takes effect at the end of the current billing period. No partial refunds for unused time.
Refunds
We offer a full refund within 48 hours of the first post-trial charge. After 48 hours, all sales are final. Email ziggytech@icloud.com with subject "Refund Request."
Price Changes
Pricing may change with 30 days' notice. Changes do not apply retroactively to current billing periods.
Intellectual Property
All content, design, code, logos, and branding of the Her Journey Suite are the intellectual property of Ziggy Tech Ventures LLC. You may not reproduce, distribute, or create derivative works from any Suite content without written permission.
Your data is yours. Your health data and personal entries remain your property. We claim no ownership over the content you create in the app.
Prohibited Uses
You agree not to:
- Use the Suite for any unlawful purpose
- Attempt to gain unauthorized access to our systems
- Scrape, reverse-engineer, or extract data from the Suite
- Use the Suite to harm, harass, or stalk any person
- Share, sell, or distribute another user's health data
- Impersonate Ziggy Tech Ventures LLC or any employee
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ZIGGY TECH VENTURES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SUITE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR ANY HARM ARISING FROM RELIANCE ON WELLNESS CONTENT.
OUR TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM. Some jurisdictions do not allow limitation of liability; in those jurisdictions, our liability is limited to the maximum extent permitted by law.
Indemnification
You agree to indemnify, defend, and hold harmless Ziggy Tech Ventures LLC and its officers, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Suite; (b) your violation of these Terms; (c) your violation of any third-party rights.
Dispute Resolution
Governing Law
These Terms are governed by the laws of the State of Nevada, without regard to conflict of law principles.
Informal Resolution First
Before initiating arbitration, please contact us at ziggytech@icloud.com and give us 30 days to resolve the dispute informally.
Binding Arbitration
Any remaining dispute shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, in Clark County, Nevada.
Class Action Waiver
You waive any right to participate in a class action lawsuit or class-wide arbitration.
Small Claims
You may bring qualifying claims in small claims court in Clark County, Nevada.
Changes to Terms
We may update these Terms at any time. We will notify you of material changes through the app, on the app's main page, or by email. Continued use of the Suite after the effective date of updated Terms constitutes acceptance.
